Sports and ball activities can involve inherent risks, and adult supervision is recommended for setting up, breaking down, transporting, storing, inspecting, and using the All Ball Pro product. Purchasers are responsible for informing subsequent users about the associated hazards, recommendations, and liability limitations related to the handling and use of this product. Please follow the directions provided on the product for its setup and breakdown.
Exercise caution during the setup, breakdown, storage, and transportation of this product. It has substantial weight and can potentially cause damage or injury if mishandled, dropped, or tipped over. Handle the product carefully, as it contains moving and folding parts that may pose pinch point hazards. Before using the product, purchasers should inspect all components to ensure they are in proper working order, and it should be set up stably on a firm, solid surface, avoiding wet or slippery conditions. All tubes, pins, joints, hardware, handles, and connections should be inspected and functioning correctly before use. Do not leave the product unattended in the setup position. When not in use, store the product in a folded-down position in a dry and safe location. While designed for outdoor use, it can also be used indoors but only in well-lit areas designed for sports play with sufficient space and lighting. The product is suitable for advanced players with elevated skills and not intended for beginners. New users should throw balls with reduced velocity and exercise caution to become familiar and comfortable with the product.
During use, all users must wear appropriate safety equipment to protect themselves from rebounded balls, including head, eye, teeth, mouth, hand, groin, and any exposed body parts. The product efficiently rebounds balls, and dense balls like lacrosse balls store significant kinetic energy when thrown with great velocity. Exercise caution when using the product, as high-velocity ball throws will result in high-velocity rebounds. It is intended for use as a ball rebounder for various sports and should not be used for other purposes.
LIABILITY RELEASE AND INDEMNIFICATION
By signing this document, you acknowledge that it affects your rights to raise a claim against the manufacturer and may be used as evidence in an adjudicative proceeding, should you choose to do so. Additionally, by signing this document, you assume all liability for any injury or damage caused to yourself or others through personal use of the All Ball Pro product or by extending its use to other users.
I am aware that the use of the All Ball Pro rebounder, which involves transporting, setting up, breaking down, and using it against a wall for practice or training, carries various risks, dangers, and hazards. These include, but are not limited to, tipping hazards, the weight of the equipment, moving parts during setup and breakdown that may pose pinch point hazards, loss of balance, difficulty or inability to control speed and direction, variations or steepness in terrain, rapid or uncontrolled acceleration on hills and inclines, mechanical equipment failure, variations or changes in the playing surface such as rocks or gravel, changing weather conditions, exposure to temperature extremes or inclement weather, travel or transport to and from playing sites, failure to play safely or within one’s own abilities, negligence of other participants, and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THEIR FAILURE TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS, AND HAZARDS INVOLVED.
